Terms and Conditions and Warranty

Information for Consumers in Distance Contracts and Customer Information in E-Commerce Contracts


§ 1 Scope

For business relationships between us and the customer regarding orders placed through the online store, the following Terms and Conditions, in the version valid at the time of the order, shall apply.


§ 2 Conclusion of the Contract

The presentation of our products on our website constitutes merely an invitation to the customer to submit an offer to enter into a contract. By submitting an order, the customer makes an offer within the meaning of Section 145 of the German Civil Code (BGB). The customer will receive confirmation of receipt of the order via email. The contract with us is concluded when we accept the customer’s offer in writing or in text form within 2 business days of the order being submitted. The decisive factor in this regard is the time at which the customer receives the declaration of acceptance. A business day is any calendar day that is not a Sunday or a nationwide public holiday.

§ 3 Right of Withdrawal

Consumers have a statutory right of withdrawal. For the legal details and terms and conditions, please refer to our separate withdrawal policy, which you can find at Right of withdrawal can view. This will also be sent to you in writing (e.g., by email) once your order is complete.


§ 4 Delivery, Shipping Costs, Transfer of Risk

Shipping costs are charged as specified in each individual case. If the customer is a consumer, we bear the shipping risk in all cases, regardless of the shipping method. If the customer is a business, all risks and dangers associated with shipping are transferred to the customer as soon as the goods have been handed over by us to the contracted logistics partner.


§ 5 Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.


§ 6 Payments

Only the payment methods displayed to the customer during the ordering process will be accepted.


Section 7: Liability for Defects

The statutory rights regarding liability for defects apply.


§ 8 Information for Consumers in Distance Contracts and Customer Information in E-Commerce Contracts

a) We are not subject to any specific codes of conduct not mentioned above.
b) You can identify any input errors when placing your order during the final confirmation step before submitting your order, and you can correct them at any time using the delete and edit functions before submitting the order.
c) Please refer to the individual product descriptions on our website for the key features of the products we offer and the validity period of limited-time offers.
(d) The language available for the conclusion of the contract is German.
e) You may submit complaints and claims for defects to the address listed in the provider information.
f) We do not store the text of the contract, and therefore, as a customer, you will not be able to access it through us after the contract has been concluded.
g) Please refer to the offer for information regarding payment, delivery, or fulfillment.


§ 9 Information on the dispute resolution procedure before a consumer arbitration board

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Refunds

We will automatically issue any refunds to the account you used for payment. If you paid by invoice or prepayment, the refund will be transferred back to the account from which the original payment was made. If you paid via PayPal or credit card, we will refund the amount to the associated account. If you used a gift card, we will credit the corresponding amount to your gift card account; please contact our customer service for this.

Return shipping is free for you, provided you use only the return label we have provided. Please send your package to the address listed on the label. Since we use two different return addresses, this is the only way to ensure your shipment is correctly routed and processed quickly without additional costs.

§ 11 Miscellaneous

The contractual relationship between us and the customer, as well as the respective terms and conditions, shall be governed by the laws of the Federal Republic of Germany. If the customer is a consumer, this agreement shall not affect the statutory provisions and rights applicable under the law of the country in which the consumer has his or her habitual residence for the protection of the consumer, from which no deviation is permitted by agreement. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

Warranty Statement

§1 Product Warranty

In addition to the statutory warranty, we offer an extended product warranty. To qualify for this additional warranty, you must subscribe to our newsletter for at least 6 months. This warranty covers manufacturing defects but excludes damage caused by improper use or normal wear and tear.


§2 Warranty Period

This warranty takes effect after the statutory warranty period ends and covers an additional year.


§3 Warranty Claims

To file a warranty claim, please contact our customer support at info@gusti-leather.co.uk. We need proof of purchase to process your claim.


§4 Exclusions and Limitations

This warranty does not cover damage caused by improper use, modification of the product, or normal wear and tear. It also excludes damage that is not due to defects in materials or workmanship. We do not cover the cost of repairing the zipper.


§ 5 Return Policy (Warranty)

We will cover the shipping costs for returns under warranty, provided that only the return label provided by us is used. We do not reimburse costs for packages that have been self-stamped or sent via other shipping providers. In addition, the return policy set forth in § 10 these Terms and Conditions.
